Sale of Island Halted

October 13th, Shelburne, N.S.An attractive 65 hectare island in Port La Tour harbour, in South Western Nova Scotia, will not be sold through a sheriff’s sale. The sale was cancelled Thursday when a Nova Scotia Supreme Court judge granted an injunction blocking the sale planned under an international treaty.

The U.S. government was trying to sell John’s Island to collect fines owed by New Jersey factory owner Herbert Zschiegner.

Zschiegner, who purchased the island in 1978, owes the American government $650,000 (US) in fines for convictions involving environmental pollution. He was fined and sentenced to four years in prison in 1995 for dumping factory chemicals into a New Jersey town’s water supply.

The U.S. government was trying to collect some of the fines under the Mutual Legal Assistance in Criminal Matters Treaty, an international agreement of 22 nations. However, the court ruled that money should be collected through a civil suit rather than through the treaty arrangement.

James Martin, a Halifax lawyer representing the U.S. Justice Department, says he’ll review the case and discuss with American authorities whether to appeal.

Several bidders showed up for the sheriff’s sale Thursday. One came from as far as Halifax with a certified cheque in hand. Norman Hill, a Dartmouth lawyer representing Zschiegner, says he’s not sure if the New Jersey man and his wife will sell the land privately. The property is slightly smaller than Point Pleasant Park and is assessed at $163,500.
